Terms & Conditions

1.Purpose

These Terms and Conditions of Sale ("Terms") govern the business aviation brokerage services offered by Takair.

Takair acts exclusively as an independent broker (Air Charter Broker) and connects its clients with airlines holding the necessary authorisations to operate private flights.

Takair is not an air carrier and does not operate any aircraft.

2.Definitions

Broker: the company Takair.

Client: any individual or legal entity requesting a quote or booking a flight.

Operator: an airline holding a valid Air Operator Certificate (AOC), responsible for operating the flight.

Flight: an air transport service carried out exclusively by an Operator.

3.Takair's role

Takair:

• searches for available aircraft matching the Client's requirements;
• negotiates the best pricing terms with operators;
• coordinates the booking;
• provides administrative follow-up through to departure.

Takair is not responsible for:

• the operation of the flight;
• operational decisions;
• delays attributable to the operator;
• changes imposed by the authorities.

4.Quote requests

Requesting a quote is free of charge.

Each quote typically includes:

• the routing;
• the aircraft type;
• estimated timings;
• the total price;
• the services included.

Quotes are valid for the period stated on them. Where no period is stated, a quote remains valid for 24 hours.

Aircraft availability can change quickly; Takair does not guarantee that an offer will remain available until it has been confirmed in writing.

5.Booking confirmation

A booking becomes firm only once:

• the quote has been accepted in writing;
• the requested documents have been provided;
• payment has been received in accordance with the agreed terms;
• the Operator has confirmed aircraft availability.

Before this confirmation, no booking can be considered guaranteed.

6.Payment

Unless otherwise agreed, 100% of the amount is payable before departure.

Takair accepts, among others:

• bank transfer;
• other payment methods as agreed.

Late payment may result in:

• cancellation of the booking;
• additional charges;
• loss of aircraft availability.

7.Pricing

Prices include only the services stated in the quote.

Unless stated otherwise, the following are not included:

• special catering;
• ground transport;
• accommodation;
• exceptional de-icing fees;
• extended aircraft waiting time;
• specific VIP services;
• costs resulting from a change requested by the Client.

8.Cancellation

Cancellation terms are those of the selected Operator.

In the absence of specific provisions:

• more than 7 days before departure: possible administrative fees;
• between 7 days and 48 hours: up to 50% of the price;
• less than 48 hours: up to 100% of the price.

Empty legs are generally non-refundable.

9.Changes

Any change requested by the Client remains subject to:

• aircraft availability;
• the Operator's agreement;
• any additional fees.

Takair will make its best efforts to accommodate requests.

10.Schedules

Communicated timings are indicative.

They may be changed due to, among other things:

• airport slots;
• air traffic control decisions;
• weather conditions;
• operational constraints;
• flight safety.

11.Safety

All flights offered by Takair are operated exclusively by airlines that:

• hold a valid AOC;
• are insured in accordance with applicable regulations;
• meet international safety requirements.

The Pilot in Command remains the sole decision-maker regarding flight safety and may:

• delay;
• change;
• divert;
• or cancel a flight.

12.Passenger formalities

Each passenger is responsible for:

• their passport;
• their visa;
• entry authorisations;
• any required health certificates.

Takair cannot be held liable for denied boarding resulting from non-compliant documents.

13.Baggage

Baggage limitations depend on:

• the aircraft type;
• the number of passengers;
• the aircraft's performance.

The Client agrees to provide the dimensions and weight of their baggage before departure.

14.Pets

Pets are accepted only:

• subject to the Operator's agreement;
• in compliance with health regulations;
• under the Client's responsibility.

15.Force majeure

Takair cannot be held liable for any delay or cancellation resulting from, among other things:

• adverse weather;
• airport closure;
• a decision by the authorities;
• industrial action;
• war;
• pandemic;
• any event beyond its reasonable control.

16.Limitation of liability

Takair acts exclusively as an intermediary. Its liability is limited to the proper performance of its brokerage role.

Takair cannot be held liable for:

• an operational incident;
• a delay attributable to the Operator;
• loss of baggage;
• any damage sustained during air transport.

17.Confidentiality

All information provided by the Client is treated confidentially.

Takair undertakes to share this information only with parties required for the organisation of the flight.

18.Data protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

The Client has the right to:

• access;
• rectification;
• erasure;
• restriction;
• objection.

19.Anti-money laundering

Takair may request proof of identity and further information in order to comply with its legal compliance obligations.

Takair reserves the right to decline any transaction that does not meet regulatory requirements.

20.Governing law

These Terms are governed by French law.

Any dispute shall be submitted, failing an amicable resolution and subject to any mandatory legal provision to the contrary, to the competent courts of Takair's registered office.
